Jury duty is one of the few duties to our country than people in this nation are called upon to perform. When a summons is received in the mail, there are several things you should do.

First, if you cannot make the date you are called for, you can apply for a postponement. This postponement can take place on any day within ten months of the originally appointed day.

The date you select must be a weekday that is not a legal holiday. It is suggested that you select a day earlier in the ten month period rather than later.

This will allow you to choose another day if an emergency comes up. If you select the last possible day and an emergency comes up you may be in a sticky spot.

However, if you can serve the date that is selected, you will need to tell your employer about it. Your employer is legally required to pay you for your normal hours for the first five days of jury service.

When the appointed day gets closer, you should receive a reminder in the mail. This letter will have parking information, directions to the courthouse, a copy of “Your Guide to Jury Service,” and any other special instructions that you may need.

If you have disabilities or concerns that you think disqualify you from jury service, you can ask to be disqualified from service. The most common reasons for becoming disqualified is that you cannot speak or understand English, you have a physical or medical disability, you are 70 years old or older and do not want to serve, you have already spent a day serving jury duty in state court during the previous three years or a scheduled to serve again soon, or you are not a citizen of the United State.

If you have a medical or physical disability, you must prove your ailment through an official letter from your doctor. Other reasons you may be disqualified is that you have been convicted of a felony during the past seven years or you are defendant in a felony occurring now, you are in jail or prison, you are a State Senator or Representative and legislature is in session, you are a judge of the Superior Court, Appellate Court, Supreme Court, a probate court, or federal court.

It is also good to know that children are not allowed to come with you to jury duty. It will be a very long, boring day for them and they often become rambunctious and distract from the proceedings.

In addition, the court does not provide child care which means that you will need to make the necessary arrangements for childcare. However, the court does allow you to give the clerk’s office telephone number to the person who is taking care of your children as a means to contact you in an emergency.

If you do not work full time, you can apply to be reimbursed for up to $50 a day for the child care. However, before you leave to attend jury duty you will need to confirm that the court still needs you.
