If your wife seriously wants to leave you, she needs to have a good reason. A judge will not grant a divorce on the whim of either party. In fact the judge must attest that your marriage has, in legal jargon, \’irretrievably broken down.\’ In other words, your marriage has ended and will not recover under any circumstances. As proof that the union is well and truly over, your wife would have to provide reasons that the court would accept. At least one of five stated reasons must be true of the marriage.

The first of these is adultery. If you have been unfaithful to your wife within the marriage then she does have the right to divorce you. The betrayal of your partner and of your marriage vows is reason enough to grant a divorce. Your wife would not be granted a divorce simply because she had fallen for someone else and wanted to be out of the marriage to begin a new relationship. This is not a valid reason for divorce in the eyes of the court.

Another reason your wife can leave you legally would be because of your unreasonable behaviour. This would mean any behavioural activity that your wife finds impossible to put up with. This might include, for example, abusive behaviour. This may take the form of verbal, physical or psychological abuse towards your wife. A further example may be drug or alcohol addiction that leads you to behave unreasonably. This would not include things such as your wife not enjoying having sex with you, for example, or not enjoying your company. Neither could she divorce you because you are lazy. Boredom and irritation are not good reasons.

Desertion is a further reason that will satisfy the court that a divorce should be granted. If you have deserted or abandoned your wife for over two years, she then has a legal right to divorce you. If you and your wife have been separated for two years and both of you want to get divorced then the judge will also accept this valid reason for going ahead and granting the married couple a divorce. However, if you do not want to divorce your wife, she would have to wait until five years of separation had passed before the judge would agree that the marriage was at an end. This is what happens when there is no agreement.

All marriages have ups and downs and many of the problems in marriages can be put to rights if the couple are prepared to communicate honestly or in some cases, seek professional help such as marriage counselling. Divorce should only be considered as an absolute final option after all attempts at reconciliation have tried and failed. Many married couples that have weathered the storm have found their union to improve later.

Divorce can be a stressful and emotional process to go through and should not be taken lightly. But if your wife is adamant that she wants to divorce you, bear in mind the reasons given above to find out if in fact she can.
