The Common Issues Addressed by Family Law
Family law addresses a number of issues. These issues include child support, spousal support, adoption and property division among other issues. Issues such as property division and spousal support are a direct result of divorce. Some matters such as adoption are not anyhow related to divorce.
Most family related issues are handled by family courts. One of the issues handled by this court is adoption. Divorces are dealt by the Supreme Court in countries that have supreme courts and by high court in countries that don\’t have Supreme Court. Divorce related issues such as child support are dealt by family courts. Such courts will have to monitor parties involved in child support on a monthly basis.
Adoption involves acquiring parental rights over a child who is not one\’s biological child. The child adopted can be an orphan, a young child who has been abandoned by his parents or a child who the courts have determined should not stay with his parents. If a child\’s parents sexual or physically abuse the child, a court of law may rule that such a child be separated from his parents. Adoption is a very tricky issue. It has to be proved, that the parents who want to adopt have the interest of the child to be adopted at heart.
Child support is normally a hot issue. During the divorce process, it has to be determined how the parents of a child will financially support a child. Children have financial needs. These needs include school fees, medical costs and costs of clothing among other costs.
Spousal support is sometimes an issue during divorce. This will be the case when one spouse does not have the income to support himself/herself after the divorce process. Spousal support will prevent the non-working spouse from having to depend on welfare. A court will use different ways to determine if a particular spouse is eligible for spousal support.
Property division is normally an area of contention during divorce. Dividing the property between the two spouses will involve a number of legal minds. It will be easy to divide property if there was a legal marriage. If two people were cohabiting together in a come we stay relationship, it will be hard to divide property.
Property will be divided according to the contribution of each spouse to the acquisition of the property. The spouse who played a big role in the acquisition of shared property will get a big share of property. If a wife did not contribute money to acquire property but he looked after the house and children as his husband was doing business and offered moral support, she will be entitled to a share of the property. Property that was acquired before the two parties who are divorcing met will not be divided.
Family law deals with issues such as child support, spousal support and adoption. Before adopting a child, a complicated legal procedure has to be followed. The divorce process also involves a complicated legal procedure. A lawyer should be hired to deal with this procedure.
