If for any reason, if the defendant fails to be present at the court on the date of his or her hearing, the bail bond becomes payable and is handed over to the court as a penalty by the surety or the person who has issued the bond. In order to protect the surety, the bail bond will usually be something along the lines of cash or any other kind of property. Most of the time bail is in cash.
The process has to be licensed. So it is signed and there is a special undertaking and insurance for the bail bond. This makes the bail agent the representative for the defendant for any charges pressed against him / her that may require a court hearing. It seems like the process requires the representative to do all the work. However, the consumer who has signed the agreement has to pay whatever may be required for the bail, be it cash or property. The bond may become void if the defendant has not kept the bail agents up to date in case of changing jobs or relocating. This is because the bail bond agent needs to know all the details of the defendant as they are the ones who will be representing them in front of the court. So it is important to make sure they have all your documents and details just in case something goes wrong. The court may give the defendant a tough time if all the details are not accurate.
