Understanding the Uncontested Divorce Process
Divorces can become very messy and unpleasant. Even couple that initially part amicably can, by the time the two lawyers have got involved, get embroiled in major disagreements.
Time is often one of the major factors that affect how amicable a divorce ultimately ends up. A lot of it comes down to the mental processes that each party to the divorce experiences. In most cases, despite making a decision to separate from each other, there is still a mutual respect for each other. Neither party wants to unduly upset each other. However, the longer it takes to finalize the divorce the more the couple get disassociated from each other. They start to lead separate lives, meet new friends and yet, because the divorce isn’t complete it always plays on their minds.
When communication starts to falter then that is often when things can start to go wrong. One party gets papers sent to them which include items that hadn’t been previously discussed. At this point it is so easy for a breakdown to occur. Arguments set in and the lawyers start protecting their clients which can exacerbate the situation.
The answer to stop this happening is to choose to get an uncontested divorce. It’s simple, fast and much less expensive.
Initially all that is necessary is for the two parties to mutually agree on everything; such as how joint belongings will be divided, how joint debts will be managed and, if there is a property involved, how the property will be split.
Next one of the parties needs to be appointed as the person filing for divorce. The great thing about getting an uncontested divorce is that you only need one law firm; the law firm only represents the person filing for divorce, but because both parties have already agreed everything then once the papers are delivered to the other party, there are no unpleasant surprises.
Once the party who is filing for divorce has been chosen just find a local law firm to arrange the papers for presentation to the other party and the court. The law firm needs to usually be in the same state as the person filing and that person needs to have resided there for at least six months. For example, if you live in Virginia and have done for over six months, then simply find a law firm in the same state. The law firm doesn’t need to be close by; there is usually no necessity to visit your chosen law firm.
Complete the divorce papers on line, making sure your spouse gets to see the papers before they are sent. This ensures that when the papers arrive your spouse already knows what to expect. You can then email the papers or print them off and send mail them to the lawyer.
The papers are prepared and sent to the other party to sign and return. They are then presented to the court and providing the papers are in order and the official requirements met, the court will declare you are divorced.
