We have all been at those parties when everyone is having a great time and it goes on much longer than anticipated. We have arrived late and want to catch up with the good mood pervading the place so we throw back a few drinks without taking the time to eat what is on offer. Here though, is where the big mistake occurs. Very often we then jump into our cars to go on to some other place and we get pulled over on a routine stop. This now is where a DUI attorney is needed to represent us in court. A DUI lawyer will have to prove our innocence to the court or at least lessen the effects of the sentence meted out.

There are those people, of course, who always take risks when they decide to drink or take drugs and then drive. These people often maim or kill others when they lose control of their vehicles because their senses are dulled by whatever they have taken. These people, obviously, deserve everything they get when they are eventually caught.

However, there are people who are inadvertently caught up in something that they would not normally do and it is these people who need more help than others for sure. For example, some people who know full well that they are probably a touch over the limit may often be called upon to help someone who has fallen sick suddenly, or perhaps they have come across someone who is unconscious and needs to get to a hospital fast if their life is to be saved. Although they are still guilty of a crime, the court will take this into account, plus their past records of course, if the expert can present evidence to show that they had no choice but to drive.

These cases are rare, for sure, but they do happen. Other cases where the driver had his drink spiked without his knowledge have also done well in the courtroom. If they can show that they do not normally drink or take any medication, they can often show that someone must have done something untoward when their backs were turned. Although this is rather stupid and dangerous, when people are having fun, they tend to do some rather unruly things which end up in disaster. How many times have we heard the phrase ‘but I was only joking’? These people indeed have made a mistake, but it is a mistake that gets others into trouble in the end.

Once arrested for the crime, each individual should have their own representation for the court date. By ensuring that all the arrest routine and incarceration was done properly, the expert will be able to point out if anything went wrong. For example, someone who was not read his rights, in the flurry of the stop and arrest phase, may well be set free unconditionally if it can be proved that this did not take place. This is surely why an expert is necessary every time.
