Cincinnati, OHIO- In part to Congress\’ lack of passing comprehensive federal immigration legislation, many states have decided to take the matter into their own hands and enact their own laws. Those states include South Carolina, Arizona, Georgia, Utah, Indiana, Tennessee and Alabama.

\”Illegal aliens do not have a voice in government, which is why these states are picking on them,\” said Ohio green card attorney Jonathan Bartell. \”Most of these laws are undermining the constitution and showcasing illegals as the enemy, which they are not.\”

This is part two of the seven-part series presented by Bartell that focuses on each state\’s immigration law. In this article the white collar lawyer addresses Arizona\’s law.

In April 2010, Arizona enacted the most stringent illegal immigration law – at the time- which was followed by debate and lawsuits from the Justice Department and several civil rights groups.

The law, presented as Arizona\’s Senate Bill 1070, was to be put into law in July 2010:

– Citizens found sheltering, hiring or transporting illegal aliens would face penalties.

– Aliens over the age of 14 who reside in the U.S. for more than 30 days would be required to register with the U.S. government and carry their papers with them at all times.

– Aliens caught not carrying their registration papers would be charged with a misdemeanor crime.

– State and local law enforcement may give reasonable effort in determining the immigration status of a person involved in a lawful stop, detention or arrest where it is believed that the individual is an illegal alien.

– State or local officials or agencies would be prohibited from restricting enforcement of federal immigration laws.

– Any person arrested would have their immigration status verified with the U.S. government.

Days before the law was to be implemented, a federal district court judge barred its most debated sections, which entitled officers to check a person\’s immigration status while enforcing other laws and that mandated immigrants to carry their papers at all times.

\”If this law were to go into effect, we would be back to the days of racial profiling, which restricts the protections we are entitled to under the constitution, such as freedom from unlawful stopping by law enforcement,\” said the theft attorney. \”This law touches on issues that reach far beyond immigration.\”

Arizona legislators have been back in the courtroom since the provisions were blocked, but they have not been successful. In part to the recent passage of Alabama\’s immigration law, which is now regarded as the toughest anti-immigration law, Arizona officials have been pushing even harder to pass their law.

\”While Arizona\’s law is not as inclusive as Alabama\’s, identical issues will still be brought forth if it is ever passed,\” said the H1B attorney.
