All About A Separation Agreement
A time comes when a couple finds it hard to stay together. When such a time comes, it is always advisable for them to make a separation agreement. A separation agreement is a written document between the two that defines how they intend to live once they cease living as one. It defines how they settle issues like child support, child custody, alimony, child visitation, debts, property, pensions, and any other issues between them.
This document is different from a prenuptial agreement and a divorce agreement. In a prenup, a couple agrees on the above issues before they get married. Prenups generally protect one of the spouses, who have valuable assets or a lot of money, from losing all of it during the divorce. A divorce agreement on the other hand, is a written court order that the couple is obliged to sign to on the said issues above.
Although it is not a legal document, it is advisable that a separating couple seek the counsel of a lawyer when preparing it. A lawyer will act as mediator so the couple comes into an amicable consensus. Each of the spouses can get a lawyer for fairness or they can always get another lawyer to further advice on the terms stated therein.
A couple acquires so many things together during their time of marriage. The most important are the children, the assets, and the finances. Penning down the agreement will simplify the problem of who takes what. This is because of;
The children need the love and support of both parents. The document spells out which spouse will take custody of the children. The spouse who does not get the children custody, he or she is allowed visitation rights that they will agree on. They need to agree how they will feed and clothe their children. The couple also has to agree on how the children will study till the end. They need to agree which schools their children will attend and how they will be paying for their fees.
They also have to agree on who will stay in the house they are currently living in or any house they might have. The business or company they own must also be decided upon. Any piece of farm or vehicles is but a few of the assets that they both own. They acquired these assets together and it is on only fair if they divided them equally amongst themselves.
The issue of finances is of uttermost importance. The document will oblige either of the spouses to support the other financially. The support mostly includes child support and alimony. If one of the couple is way financially able than the other, he or she should support the children and the custodian for the agreed amount of time. They also have to agree on the debts they have which may include car loans or mortgages.
A separation agreement will make sure that neither of the couple suffers the effects of the separation alone. It also makes sure that the children will never be affected by the decision. It lessens the legal expenses and at the same time makes sure that one of the partners will sue the other for refusing to honor the terms laid down.
