The lemon law was signed into legislation in order to prevent automobile manufacturers from creating unfair and/or unethical warranties. It also makes it possible for consumers who are sold a product with a value of $25 and up, with a written warranty to seek damages when sold a lemon.
The Uniform Commercial Code, applicable in all fifty states, gives the consumer the right to a refund or replacement when found to be the victim of being sold a lemon. The laws do vary from state to state, so please research the specifics as they relate to the state in which you live. Because the lemon law is not cut and dry, you will have the burden of proof put upon you if you feel you\’ve been sold a lemon. However, do not let that stop you from seeking remediation! There are steps you can take to right the wrong.
Keep explicit records of what malfunctions your vehicle experienced. Track dates, times and exactly what went wrong. Just as importantly, and maybe even more so, document how you attempted restitution through your own efforts. With whom did you speak? When? What time? Was a solution offered? If so, what was suggested? If you still receive no satisfaction it is highly recommended you hire a lemon law attorney. If the applicable laws are not clear in your state, a lemon law attorney will be able to provide the best response by combining information from the laws of other states.
Due to the ambiguous nature of the lemon law, the term \”lemon\” may be left to interpretation. This is why it is so vital you keep copies of your written warranties and all documentation surrounding your attempts at resolution when you find yourself with a lemon. By no means should you forgo seeking restitution! Keep good records, be strong in your conviction and if you still do not receive a satisfactory solution, hire an attorney.
