If there is such a thing as a good divorce, then an uncontested divorce is certainly the most painless method open to you. It can be fast and often most importantly, is by far the least expensive way to divorce.

The law states that an uncontested divorce is one where both parties amicably agree to sign the appropriate divorce papers, or one party does not respond to the divorce papers within a specified period of time. It is also possible to obtain an uncontested divorce by publication. This is an option if your partner doesn’t reside in Virginia, or you no longer have their address. The divorce details are then published and if a response isn’t received, then the case proceeds as an uncontested divorce.

Specialist law firms in Virginia offer a variety of options to obtain an uncontested divorce. Each option has a set fee basis and the cost varies based on how quickly to want to get your divorce settled. It can be as quick as one week, if both parties agree to sign the documentation and one has lived in the state of Virginia for at least six months. Additionally you must have been separated for six months and there cannot be any young children involved. This is the fastest type of uncontested divorce and can easily be completed for well under $1,000.

If you are both willing to wait a little longer to get the divorce, then a less expensive option is to go for a three week divorce. You are likely to be able to complete this for about $500. The parameters are the same as for the one week divorce, except that if you do have young children, you must have been separated for a minimum of one year.

If you are unable to make contact with your partner, or the partner lives outside the state of Virginia, but you have lived in Virginia for at least six months, then you can still obtain an uncontested divorce by publication. However, this type of divorce requires a two and a half month wait, following publication in a newspaper, and you need to have been separated for at least one year; unless your partner has already signed an agreement. The cost for this type of divorce is likely to be about the same as for a three week divorce.
