An uncontested divorce is very inexpensive. It has its pros and cons but the relatively lost cost when compared to the contested variety is definitely a positive. The money saved on court costs and lawyer\’s fees can be turned toward the needs of former couple\’s children and toward starting a new life.
Searching the internet will produce many lawyers and law firms which specialize in low-contested, low-cost actions and filings. The most important factor to consider is, however, the lawyer\’s and firms credentials and any hidden costs that might be incurred. It is always wise to have an interview with a few selected lawyers before deciding on the one which is right for an individual\’s situation and needs.
When a couple wishes to end a marriage without a lot of controversy or difficulty, this is the easiest route. The couple amicably divides assets, properties, etc., and meets with a lawyer to prepare legal documents. If the each of the couple agrees to all terms and conditions, once signed and witnessed, the official documents will be presented to a court of law.
The important issues regarding divisions of assets, properties and finances and children\’s issues will be most fairly decided upon under the guidance of a lawyer. Each party must secure their own legal council. One lawyer cannot legally represent two people on opposing sides.
When a judge decides all requirements are met satisfactorily, they will issue a decree of divorce and all will be settled discreetly and quietly. There are usually never any controversies in regard to money or children in this type. If and when these kinds of problems arise, it is advisable to hire another lawyer and follow contested procedures and protocols.
This type of divorce is not for everyone. For instance, if one of the couple is determined to secure as much money as possible from the opposite party, or if there are property or asset issues which cannot be resolved peacefully within a reasonable amount of time, this type will not work. If child-care or custody issues are difficult, this is not the route to take.
If there are issues regarding abuse, physical, emotional or psychological, clearly this route will not be the one to take. Sometimes one of the parties will be reluctant to compromise on certain points in the separation agreement but often time, or mediation, will resolve some of these issues.
Mediation might be a valuable resource to take advantage of in these cases. Although valuable in moving issues to a quick resolve, mediation could drive up the initial costs. In the long run, however, taking advantage of these resources will eliminate the need for many sessions with lawyers and costly court dates.
Reading books, doing research online and interviewing lawyers may be time-consuming, but being well-informed is the best way to proceed with this method. It may seem ironic, but if a couple gets along in regard to all the divorce details and are in agreement as to how to end their marriage, uncontested divorce will offer the best results for very little cost. The only high cost will be the end of a marriage.
