Compensation Structured to Meet the Needs of Those Injured
Those people who are unlucky enough to be injured in work or in a car accident will surely be entitled to some compensation when they have recovered from their injuries. Of course, some people will never recover fully and this is taken into account when any offers are made. Indeed, they may be offered something called a structured settlement which is paid over a length of time just when the victim needs them. Structured settlements are becoming more popular because once a full and final offer has been made and accepted, no other compensation will be forthcoming no matter what difficulties that person faces as they get older.
People may need ongoing treatment when they have been severely damaged so those who have to make these payments will often pay an insurance company to take over the administration of such awards. Major insurance companies normally take up these offers and will draw up a plan to release monies over a specific period as and when they are needed. In fact, once the injured party has proven their case against the person or company, they usually embark on lifelong treatment schedules that literally change their lives forever.
Take, for example, someone who is damaged in a car accident. Initially, they will not be suffering so badly, but given time, their injuries will worsen and the real damage will become very apparent. Whiplash injuries, for example, are so destructive to the skeleton that once the person has been damaged in this way, they will never be the same again. Over time, the condition deteriorates and they may end up in a wheelchair no less so they will certainly need ongoing physiotherapy at the very least. If they do not take care of this in the payment plan, they may end up depending on the government for help and this is no good at all.
By undertaking this kind of plan by those who are held responsible, even things like retirement benefits, college fees, medical needs and anything else that this injured party will have to contend with will be taken into account so that the money will be there when it is necessary. The accused in this case will certainly have to pay into this scheme so that all the payments are kept up to date for the injured party so this makes it easier for him too. If he was asked to pay some vast sum to the injured party, this could well put him out of business or even make him bankrupt too. Since he will also have to take care of his own family as well, this could become intolerable for sure.
Both sides will obviously need their own experts in this field so that no one feels like the injured party, so to speak, and each will have to agree on what payments will be made and when. Although this kind of arrangement will not suit every occasion, it certainly is another way to look at the matter but only with expert guidance, of course.
